Introduction

Pelagic Data Partner processes personal data of its customers, potential customers, and other contacts. We do this to fulfill potential agreements. In this privacy statement, we explain why and how we process your personal data.

We do not employ a Data Protection Officer, but we are happy to assist you with any questions regarding our privacy policy at info@pelagic.nl.

Which personal data does Pelagic Data Partner process?

Below is an overview of the personal data we may process, depending on the products or services you purchase or use:

  • First and last name

  • Address

  • City/Town

  • Phone number

  • Email address

  • Company name

  • Company address details

  • Location data

  • VAT number

  • Contact history

Other personal data that you actively provide, for example, by registering on our website, in correspondence, or by telephone.

Legal obligations

A small portion of our processing is required by law. This mainly concerns personal data necessary to comply with our tax obligations.

Newsletters and mailings

Occasionally, we send newsletters and/or mailings. Sometimes these are personalized based on certain actions you have taken or products and/or services you purchase from us. You always have the option to adjust your preferences for receiving newsletters and mailings.

Automated decision-making

Pelagic Data Partner does not make decisions based on automated processing (algorithms) that could have adverse consequences for you.

Rights of data subjects

Under the GDPR, everyone has several rights. We do our utmost to comply with these as effectively as possible. Do you have tips or comments? Please let us know! To exercise your rights, you can contact us at info@pelagic.nl.

  • Information and inspection: You can, of course, see which of your personal data we process. We are also happy to explain more about how and why we process that data.

  • Rectification: If you believe we have incorrect data about you, let us know and we will correct it.

  • Right to be forgotten: You can request the deletion of the personal data we hold about you. It is possible that we may still need to process that data for other purposes (such as administration or deduplication).

  • Restriction: If you feel that we are processing your personal data unlawfully or incorrectly, you can request to restrict that processing.

  • Objection: You can lodge an objection to the processing of your personal data. If it concerns marketing, we will terminate that processing as soon as possible.

  • Portability: This is a right under the GDPR to transfer or have your personal data transferred. If you wish to make use of this, please contact us.

Additionally, you can:

  • Withdraw consent: For example, for receiving emailings. If you wish to withdraw consent for any other processing, please contact us at info@pelagic.nl.

  • File a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens – AP): If you believe we are not acting in accordance with privacy legislation, we would like to hear from you. You also have the right to lodge a complaint with the AP.

How long do we keep your personal data?

Personal data may not be kept longer than necessary. The retention period depends on the purpose for which we received or collected the data and any legal obligations to retain data.

If you have requested a quote from us but did not become a customer, we will delete your data no later than two years after our last contact. Similarly, if we received a quote from you but did not become your customer, your personal data will be deleted no later than two years after our last contact. If you did become a customer of ours (or vice versa), we will retain your personal data for a period of seven years after the end of the fiscal year in which the agreement was fully executed. This seven-year period corresponds with the period we are legally obliged to keep our records for the Tax Authorities. After this period, we will delete your personal data.

Grounds for processing

As explained above, we process some data to fulfill a legal obligation, some for the performance of an agreement, and most for the legitimate interest of Pelagic Data Partner: the execution of our business objectives. Disclosure to third parties

In connection with the execution of a possible agreement with you, it is possible that we must provide your personal data to parties that supply products and/or services to us or perform work on our behalf. Furthermore, we use external server space for the storage of (parts of) our sales and purchase administration, of which your personal data is a part. For this reason, your personal data is provided to our server space provider.

How Pelagic Data Partner secures your personal data

We take the protection of your data seriously and take appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. If you feel that your data is not properly secured or there are indications of misuse, please contact info@pelagic.nl.

We have taken the following measures to secure your personal data:

  • Servers and devices of our employees are equipped with up-to-date security software, such as virus scanners and firewalls.

  • We only send your data via secure internet connections (SSL). You can see this by the ‘https’ in the address bar and the padlock icon.

  • Access to personal data from mobile devices is restricted and actively monitored.

  • DKIM are internet standards we use to prevent you from receiving emails in our name that contain viruses, are spam, or are intended to obtain personal (login) details.

Pelagic Data Partner uses cookies. We do this so that we can stay informed about the maintenance of the website and to analyze website traffic through Google Analytics.

1. Functional cookies Cookies that are necessary for the website to function properly or that ensure you can use the website more easily. For example, storing your login details so you don’t have to log in every time. Closing the cookie notification also falls under functional cookies.
